This company and it's owner are involved in criminal activities.
IBM Bermuda is well aware that this equipment is stolen and not only helped in the theft of this equipment they also helped to install it and to cover up the theft.
The Bermuda Government is helping these companies perpetrate a crime act against the rightful owner of this equipment.
Be aware Bermuda does not conform to the laws of North America or Europe you will not be able to recover any property shipped to this country if you have not received payment in advance. Make sure you get your money up front or at the very least held in trust before you ship anything to this country.
This also applies to anybody selling goods to residents of Bermuda.
The following people do not pay their bills and can not be trusted to honor any agreements

Both of these people are residents of Bermuda and are directly responsible for the theft of over $84000.00 of Computer equipment from the Bermuda Customs area in January of 2008.

At a time when the world is in a financial crisis anybody thinking of doing business in Bermuda needs to be warned about criminal activities and the companies that will use the power of the Bermuda Government and its court system to commit fraud, extortion and other criminal acts.
So you clearly understand, EVERYTHING shipped to Bermuda becomes the property of Bermuda once it enters the country. The Government agency's charged with the protection of Bermuda has absolutely no interest in protecting any outside foreign suppliers or their property. The Bermuda Courts will protect the interests of a Bermuda company over any foreign entity. The Bermuda Supreme court will never against a Bermuda citizen or company.

If you are a supplier to BGA or your thinking of starting trade with a company in Bermuda. To any company associated with the BERMUDA company BGA Group of Companies you are at risk of having your property stolen. This company has stolen computer equipment from several companies in the US and has even stolen equipment from ex-employee's.
The Bermuda Government has provided BGA protection from any possible foreign prosecution after BGA Stole a valuable piece of computer equipment. Your ability to recovery your property legally will be stopped by Bermuda law enforcement as well as from every Bermuda government agencies.
This is a "THIRD WORLD COUNTRY" with a government riddled with corruption. Bermuda may give the world the impression that they are just another tourist trap that follows the UK legal system as well as the Banking rules of the world, they do not! They do have laws in place that allow criminal activity. Be aware criminal organizations policing criminals will always disregard all laws whenever a foreigner is involved. You will never get your property back if it is stolen by this or any other Bermuda Company.

Do not make the same mistake other people have made, the government agencies of Bermuda are corrupt and will not assist foreigners in the retrieval of your property, you have no rights under Bermuda law, nobody will protect your interests.
A lot of people assume that the people and companies of Bermuda are honest. While their are a lot of very nice and honest people living on this island, not everybody you meet is honest.
In the process of covering up their activities, the management of BGA stole a piece of valuable computer equipment from an ex-employee.
Nobody seems to know exactly why they decided to steal this equipment valued at over $84000.00 but apparently their justification was based on their ability to manipulate the legal system and retaliation for an employee's refusal to participating in the companies criminal activities. According to the owner of the equipment, the management of BGA conspired to steal his computer equipment after he refused to participate in activities that would have defrauded the company and Bermuda's Financial institutions as well as other company suppliers.
Apparently that ex-employee knew about their activities and the activities of their sister company the Phoenix stores and was forced from their employment and later from the island by the Bermuda Government at the insistence of the owner Mr. Wendall Brown. While Mr. Brown is not a member of the Bermuda Government, he does however appear to have the same power as the Minister of Immigration which allowed him to order Bermuda immigration offices to dispose of this person with a simple phone call. Once the owner of the computer equipment was forced to leave Bermuda, BGA was then able to manipulate the courts who then seized the opportunity to use the circumstances to make sure this person never bothered BGA again by imposing penalties far beyond his capabilities.
Several months prior to forcing the owner of the computer equipment off the island, the CEO of BGA decided he wanted the computer equipment but didn't want to purchase it from the owner. He then sent one of his people to STEAL the equipment from the Bermuda Customs area at the Bermuda airport. He had no proper authorization or permission but Bermuda Customs handed over the equipment anyway. The CEO of BGA then covered up the theft by getting the government to force the owner off the Island. While the owner of the equipment still has the proper documentation, a bill of sell which clearly states he is the rightful owner. In addition a letter from the seller stating that the equipment is the rightful property of the former IT manager, that he is the purchaser and owner of the equipment and in very clear terms that the Bermuda company known as BGA Group of companies and any of its representatives are
NOT THE OWNERS OF THIS EQUIPMENT.
Because of the relationship between BGA and the Bermuda customs department, they handed over the equipment without asking for proof of ownership. The equipment was clearly NOT addressed to BGA and was specifically addressed to the real owner as per the shipping instructions.
Their is nothing anybody can do about that except this......
The legal system and law enforcement in Bermuda take their orders from the management of BGA and will not carry out any legal proceedings against this company.

This company has STOLEN a piece of very valuable computer equipment. They were assisted by the Bermuda Government. The equipment does not belong to them and the real owner has documented proof. BGA is presently using this computer equipment at their Bakerylane warehouse to run their company. They are using the equipment without the permission of the real owner. This equipment was STOLEN and is not the property of BGA Group of companies or its representatives.
The Bermuda Government along with the Bermuda Court system has aided in the theft of this equipment in an effort to protect this company.
This is a warning to anybody doing business in Bermuda. This countries government and court system is corrupt.
This is a WARNING to all company's world wide, the BGA Group of company's have stolen a piece of computer equipment valued at over $84000.00, if you have any business dealings with this company be aware that this company participates in criminal activities and if you do any business with this company you will not be able to recover your property. Also this company has the full protection of the Bermuda legal system, The Bermuda law enforcement agency and the Bermuda Government. Any complaints filed against this company will go unanswered. Any complaints filed with the Bermuda ombudsman about this companies ability to control the government will also go unanswered.
The legal owner of this Computer equipment tried to recover his property by going through the Bermuda court system. He received the full wrath of the Bermuda court system and was denied his property. If you are put in the same position be WARNED, the legal professionals in Bermuda are by the standards of the US, Canada, the UK and Europe are criminals. They do not follow the laws and because they can get away with it, have no problem participating in criminal activities. You will lose any legal action you bring before the Bermuda courts and it will be expensive, save your money, you won't win! If you try to use the Bermuda court system to recover your property all you will get is a big bill and if the court doesn't steal the money your lawyers will.
In October of 2005, the CEO of the company "BGA Group of Companies" hired an contract IT manager from the US to provide computer support services for what was the worst computer facility in Bermuda. That job required the purchasing of new equipment.
The equipment that he purchased over the next 2 1/2 years was to be used for the operations of the company. In February of 2008 the IT manager for BGA was forced to resign by the management of the company after he refused to participate in the company's criminal activities. Two weeks after he was fired from his position a piece of computer equipment ordered and owned by the ex-employee of BGA arrived on the island and was stolen by BGA with the assistance of the Bermuda Customs department. Before the equipment was shipped for delivery very specific shipping instructions on delivery were given to the seller. When the equipment arrived in Bermuda the CEO of BGA conspired to STEAL that equipment.
The equipment was STOLEN by BGA from the Bermuda Customs warehouse without the owners knowledge or permission and was taken to the BGA warehouse.
After confirming that a BGA driver did indeed STEAL the equipment as per the instructions of the CEO of BGA a formal letter was sent demanding the return of that equipment or face legal action. The CEO of BGA Mr. John Tomlinson has never acknowledged that letter.
To this date the equipment has not been returned.
On June 27th 2008 a lawsuit against BGA Group of Companies was filed in Bermuda Supreme court.
BGA systematically eliminated the owners ability to live and working in Bermuda. The Bermuda Government was told to eliminate all possibility of employment on the island and then to force the owner of the equipment off the island which they did on June 4 2008. Because the owner of the equipment was force off the island BGA's lawyer then used a little known law, enforced by the Bermuda courts in an attempt to extort $20000.00 with the demand that the court case would not continue if the money was paid. In addition the owners legal representation a Mr. Michael Smith of Smith and Co. mysteriously disappear allowing for no opposition.
The Judge in the case dismissed the suit after the owner refused to pay the money.
And although the case was never allowed to proceeded because of a failed extortion attempt the Bermuda Supreme Court award damages.
The Computer equipment has never been returned.
The court did not award the computer equipment to BGA.
Bermuda Customs refuses to admit they did anything wrong but they did admitted that BGA had no proof of legal owner ship and that they represented themselves as the employer of the owner which they were not. The computer equipment is not the legal property of BGA.

In June of 2008 the former Information systems manager for BGA left the island of Bermuda after the Bermuda immigration department took away his permission to seek employment on the island. After waiting over 20 weeks to get that permission back the former IT manager for BGA was forced to leave by the Bermuda Immigration department, after being told by the owner of BGA to have him removed from the island.
More than a year later that equipment has not been recovered. The Theft of that equipment has caused a great personal debt. In addition BGA and their lawyers continue to harass the ex-employee's family.
Their has never been an explanation given for the theft and BGA has never offered to provide compensation.
To this date BGA is using this piece of very expensive and highly technical computer equipment to run their company, It is clearly not their property and they do not have any documentation to prove it is.
The legal owner has documented proof from the company that supplied this equipment that clearly states that the representitives of the BGA Group of Companies are not the legal owner of this computer equipment and that the equipment was not to be delivered to this company. The equipment was clearly addressed to the purchaser and the invoice had clear instruction directed at Bermuda Customs officers to identify the owner, clearly that was NOT BGA.
THIS IS A WARNING TO ANYBODY SENDING ANY GOODS TO BERMUDA COMPANY'S.
BERMUDA CUSTOMS WILL RELEASE ANY ITEM TO ANYBODY AND WITHOUT APPROVAL OR PROOF OF OWNERSHIP.
GET YOUR MONEY UP FRONT.
THE OWNER OF THIS EQUIPMENT TRIED TO GET THE BERMUDA COURTS TO RECOVER THIS EQUIPMENT IN ACCORDANCE TO BERMUDA LAW.

Two weeks later that equipment arrived in Bermuda and was picked up shortly after by representitives of BGA without any authorization or the expressed written permission of the owner and was held at the BGA warehouse. BGA management has used the Bermuda government to force the real owner off the island.

Because Bermuda allows their citizens to commit murder without penalty they have absolutely no problem committing other criminal acts against any foreigner.
